These are great questions to ask your financial planner - the kind of questions I love when my clients ask them of me. Given the turbulent markets, it is important to have a strategic plan. The longer the time frame until you need the cash, the less change you need to make to a well balanced portfolio. I find that many people panic and make changes they do not need to make.

I have also seen examples where clients have walked in with forms pulled from the internet or sometimes they have their parents documents and decided they could just do their own based on their parents. The fact that their parents will is from the 60's and the law has changed ten times over never seems to cross their mind. These are accidents waiting to happen. E Green. http://taxchatter.wordpress.com

Guardianship is designed to protect incapacitated people, but it's become a tool to victimize both the incapacitated and those who aren't incapacitated instead. The guardians and lawyers get rich while giving their Wards the shaft.

Courts are routinely forcing guardianships despite advance directives executed and in place --- families are destroyed, bank accounts broken. The horror is almost undescribable.

For more information about the dark side of guardianships, visit the National Association to STOP Guardian Abuse at www.StopGuardianAbuse.org and read victim's stories.
